US prosecutors' memo seeks pretrial detention of ex-OpenAI engineer Abdulrahman Alfozan, saying he was days from leaving for Saudi Arabia

In one minute

US federal prosecutors asked a court to detain former OpenAI engineer Abdulrahman Alfozan pending trial, according to an October 18, 2026 memorandum filed in the Northern District of California.

The filing says Alfozan is charged under 18 U.S.C. § 2511(1)(b) with using or attempting to use a device to intercept oral communications. Prosecutors allege that around September 28 he placed a concealed audio-recording device in a USB port behind a television in an executive OpenAI conference room. The memo says the device used encrypted microSD storage.

Prosecutors say Alfozan was arrested on October 9, three days before a planned one-way flight from San Francisco to Riyadh with his wife and son. The filing says OpenAI terminated his employment after the arrest; it lists his final base salary as $385,000 and a $2.2 million profit-participation equity grant. A detention hearing was scheduled for October 19.

The memorandum is the government's argument for pretrial detention, not a judicial finding. It does not establish that the alleged recording occurred, that information was obtained or transferred, or the outcome of the detention hearing or criminal case.
