OpenAI faces US wiretapping suit over ChatGPT ads tracking pixel

In one minute

MLex reported on October 27, 2026, that OpenAI faces US litigation over its advertising measurement pixel.

What changed: A new US wiretapping lawsuit alleges OpenAI’s advertising pixel tracks browsing and purchases without consent, including for people without ChatGPT accounts.

The suit concerns tracking on advertisers’ websites connected to ChatGPT advertising and describes the pixel as newly released technology.

The plaintiffs allege that the pixel invisibly logs site visits, including visits by people who do not have ChatGPT accounts. They further allege that browsing activity and purchases can be linked to identifiable individuals without consent. The report says the claimed tracking occurs on advertisers’ websites, rather than solely within ChatGPT.

The complaint alleges violations of the federal Wiretap Act and wiretapping laws in California and Pennsylvania. These are allegations by the plaintiffs. MLex does not establish that OpenAI conducted unlawful tracking, that a court has ruled on the claims, how the pixel technically operates, whether the alleged data linkage occurred, or OpenAI’s response to the suit.
